TII has a requirement to enter into a Contract for the supply of Trunked Terrestrial Radio (TETRA) radio system. Luas trams and operational staff use a private TETRA radio system to communicate across the light rail system, between Luas vehicles and the various supervisory systems as well as for Luas drivers and staff. Luas TETRA Radio facilitates the transfer of voice and data communications for Luas, including Automatic Vehicle Location System (AVLS) reporting which is essential for managing the Luas operations. Luas onboard radio modules are obsolete and no longer serviceable or obtainable. Direct replaceable, next best equivalents are not available. The Luas AVLS system is a proprietary design by Project Automation SpA. Similarly, the Luas Radio system is a TETRA radio system developed by Motorola. Communications interfaces between these two systems are critical for the proper functioning and performance of the voice and data communications for the Luas trams. This Contract is fundamental to the continued safe operation of the Luas light rail network and so is well aligned to TII’s business plans. It also speaks to TII’s strategic goals by ensuring a resilient Luas onboard radio system capable of continued service into the future. As set out in the Recitals to Directive 2014/25/EU Article 50, point (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons: (i) the aim of the procurement is the creation or acquisition of a unique work of art or artistic performance; (ii) competition is absent for technical reasons; (iii) the protection of exclusive rights, including intellectual property rights; The exceptions set out in points (ii) and (iii) shall only apply when no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement; Following the expiry of this VEAT Notice, it is intended to sign a contract with with Sigma Wireless Communications (Project Automation SpA / Ervocom AG will act as subcontractors to Sigma Wireless Communications).
